Articles of Agreement made this twelfth day of February in the Year One thousand eight hundred and two BETWEEN Samuel Jordan Cabell of Kanawha County and State of Virginia Attorney in fact for John P Du Val of Mason County and State of Kentucky of the one part and James Jordan Senr of the aforesaid County of Kanawha of the other part WITNESSETH That the said Samuel J Cabell for and in Consideration of the sum of Three hundred and thirty seven pounds ten shillings to be paid by the aforesaid James Jordan One hunred Pounds part of the said sum of Three hundred thirty seven pounds ten shillings is paid into the hands of the said Cabell before the Sealing of these presents and bonds given the one payable the 15th day of November next for the sum of One hundred and fifty Pounds and one other for the sum of Eighty seven Pounds ten shillings payable on the 15th day of November in the year 1803 hath Bargained and sold unto the aforesaid James Jordan five hundred acres of land being part of a Tract of land containing One thousand Acres lying on Mud River in the County of Kanawha aforesaid belonging to the aforesaid John P. Du Val which sale the aforesaid Sam’l. J Cabell makes by Virtue of a Power of Attorney to him made by the aforesaid John P. Du Val in November 1798 and which is recorded in the Court of Kanawha County. BEGINNING at a White oak nominated by the aforesaid Du Val and Jordan and running thence South fifty eight degrees East two hundred poles on that line. then beginning at a sugar tree on the North East side of the River as agreed on by said Du Val & Jordan and running up the line of the said survey two hundred Poles thence running across the said survey a direct line to the end of the two hundred poles first made which land contained within those lines are to remain the property of said Du Val then beginning at that Corner and extending upwards along said line so as to include the Improvement whereon said Jordan lives. then beginning at the Corner made on the line on the North East side of the River and extending up that line so as to include five hundred Acres. And the aforesaid Samuel Jordan Cabell doth by these presents Covenant and Agree that on the said James Jordan making payment of the aforesaid sum of Three hundred and thirty seven Pounds ten shillings in manner and form aforesaid to make or cause to be made unto him the said Jordan a good and sufficient Title in fee simple with a General Warranty in and to the premises hereby sold to him. And for the true performance hereof the parties bind themselves each to the other in the sum of One thousand Pounds. In witness whereof they have hereunto set their hands and seals the day and year first above written.
